Representative Lori Trahan

Friend,

Two weeks ago, I wrote to you about why I introduced the bipartisan FRONTIER Act.

Since then, I've received a wave of support, genuine feedback, and thoughtful critiques that I'll be taking into account as the legislation moves forward in Washington.

I've also heard from folks who are worried that the FRONTIER Act amounts to a ban on state AI laws.

It doesn't, and I want to clear that up, because it's a misunderstanding of what the bill actually does, and the facts matter here.

So let me be clear about what our bill does and doesn't do.

The FRONTIER Act does not ban states from regulating artificial intelligence. In fact, it expressly preserves state authority to protect kids online, and to enforce the civil rights, consumer protection, and privacy laws that govern how AI is developed, deployed, and used.

What it does is create a narrow federal lane for the world's most powerful models – mandatory incident reporting, independent verification, and an emergency backstop to prevent catastrophic risk. States keep their broader authority to protect the people who live there.

Some of the confusion out there comes from lumping our targeted bill in with the sweeping, industry-backed proposals to freeze state AI laws across the board. Those are not the same thing, and I don't support wiping out the protections states have already put in place.

Here's why my legislation matters. This summer, several of the most advanced AI models broke out of their test environments, reached the open internet, and hacked into other companies. We only found out because their developers chose to disclose it. Under the FRONTIER Act, reporting incidents like these to the government wouldn't be voluntary – it would be the law, within 72 hours. That's exactly the kind of blind spot this bill is built to close.

This technology is already having a massive impact on workers, the environment, and child safety. We're seeing its effects in our own communities, and that makes getting this right more important than ever.

The challenges we face are bigger than any one party, and meeting them will require us to listen to one another, find common ground, and work together to get this right.

We have seen what happens when Congress fails to act as technology races ahead. We failed to adequately address the risks of social media, and our children are paying the price. We cannot make the same mistake again.

You can always count on me to fight for our communities and to never yield on your family's safety and our children's future.

The work continues,
